Chief Magistrate Judy Latchman refused to revoke bail of Azruddin Mohamed on Friday.
During extradition committal proceedings against Azruddin Mohamed and his father Nazar Mohamed, the prosecution raised the bail revocation issue shortly before a scheduled noon adjournment. Special Prosecutor Glen Hanoman brought the matter to the magistrate's attention under Section 7(c) of the Bail Act.
Police are currently investigating Azruddin Mohamed for alleged presence near President Irfaan Ali’s Leonora residence on Thursday night. The alleged incident involved an armored vehicle and a drone. Police are still examining seized cellphones.
Glen Hanoman said a prospective presidential candidate presenting outside the head of state’s private home at night warrants strict scrutiny.
Roysdale Forde labelled the bail application "ridiculous, flimsy, and without any substance." He said the state presented zero material evidence proving a breach of bail conditions.
Defence attorney Siand Dhurjon said Mohamed had gone to the location to investigate complaints as part of his duties.
Chief Magistrate Latchman reminded the court that Mohamed remains on valid bail conditions and held that Mohamed’s liberty could not be revoked without evidentiary justification. The law instructs courts to consider revoking bail if a defendant is likely to face serious new charges.
